These terms and conditions (the "Terms and Conditions") govern the use of www.magicalbusiness.ca (the "Site"). This Site is owned and operated by MAGICAL CREDIT INC., operating through its subsidiary brands Magical Business, Magical Cash, and Magical Credit. This Site is a service website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property

All content published and made available on our Site is the property of MAGICAL CREDIT INC and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Accounts

When you create an account on our Site, you agree to the following:

• You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
• All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Provision of Services

These Terms of Use govern the provision of services available on our Site. The following services are available on our Site:

• Business financing and related advisory services

These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to apply for services from our Site at your own risk.

We reserve the right to modify, reject or cancel your application whenever it becomes necessary. If we cancel your application and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Consumer Protection Law

Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability

MAGICAL CREDIT INC and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless MAGICAL CREDIT INC and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of Ontario.

Severability

If at any time any of the provisions set forth in these Terms of Use are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms of Use may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Privacy Policy

By submitting the Magical Credit Inc. application form, you give Magical Credit Inc. permission to contact you regarding our services. Also, by way of this form, and in accordance with our Privacy Policy, you consent to Magical Credit Inc. assembling, using or revealing your personal information for the purpose of authorizing your identity, defining whether you are eligible for the services for which you have applied to, and for any other purpose identified in our Privacy Policy.

Magical Credit Inc. provided this Privacy Policy to describe our personal information handling practices, and to assure you of our ongoing pledge to take steps to protect all personal information that you provide to us and other third party sources. "Personal information", as used in this Privacy Policy, means information about an individual.

Handling Personal Information

At Magical Credit Inc., we collect personal information primarily from you, for instance through applications and supporting documentation you provide. We may also collect personal information about you through your ongoing interactions with us, whether it be from references, employers or other financial institutions you have identified in your application as well as credit bureaus and other third party sources. For example, we may collect personal information from credit bureaus for the purpose of locating you to collect outstanding debts. In connection with loan agreements, we may also collect personal information from credit bureaus in order to verify your current and ongoing creditworthiness and other information you may provide to us.

We may collect and use personal information for various purposes such as, but not limited to: managing business activities, verifying identity and other personal information, evaluate requirements and eligibility, advertising and promotion, establishing business relationships, collecting outstanding debts, and maintain records.

All personal information is safely and securely stored within our servers with proper layers of security ensuring its safety. Information is accessed by Magical Credit Inc. and is not passed on or disclosed to any third parties unless specifically outlined in the "Disclosing Information" section below. All personal information received is given with the full consent of the individual when an application is received, either electronically or verbally.

Disclosing Information

Magical Credit Inc. holds the right to disclose personal information without the individual's consent or knowledge only:

• To a lawyer or legal representative of Magical Credit Inc.
• To collect a debt the individual owes to the organization
• To comply with a subpoena, a warrant or an order made by a court or other body with appropriate jurisdiction
• To a government institution that had requested the information, identified its lawful authority to obtain the information, and indicates that disclosure is for the purpose of enforcing, carrying out an investigation, or gathering intelligence relating to any federal, provincial or foreign law; or suspects that the information relates to national security, the defence of Canada or the conduct of international affairs; or is for the purpose of administering any federal or provincial law
• To a government institution or an individual's next of kin or authorized representative when there are reasonable grounds to believe that the individual has been, is or may be the victim of financial abuse

Magical Credit Inc. does not in any way collect personal information indiscriminately nor does Magical Credit Inc. deceive or mislead individuals about the reasons for collecting personal information.

Magical Credit Inc. only uses or discloses personal information for the purpose for which it was collected, unless the individual consents, or the use or disclosure is authorized by the Act (PIPEDA). All personal information is retained for as long as necessary to satisfy purposes.

Magical Credit Inc. investigates any informed complaints and takes appropriate measures to correct information handling practices and policies.

Magical Credit will use Cookies and Pixel Tags to track users that come to our site. Cookies record information about your online preferences and allow us to tailor the website to your interests.
